Welcome to Pokeman. The Pokeman application, software, and related services (collectively, the "Services") are provided by FSTCK, a company registered in Paris ("Licensor"). By accessing or using the Services, you agree to these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein. If you do not agree, you are not permitted to use the Services.
Pokeman is a mobile application designed to help users scan, identify, and organize Pokémon trading cards for personal, non-commercial use, offering features such as scanning cards with the device camera, managing personal collections, viewing estimated values or rarity information when available, and accessing optional premium features through in-app purchases or subscriptions, while remaining an independent fan-made tool unaffiliated with The Pokémon Company International, Nintendo, Game Freak, or Creatures Inc.
You must be at least 4 years old or meet the minimum age requirement in your jurisdiction to use the Services. If you are under the age of majority in your jurisdiction, you must have the express consent of a parent or legal guardian. By using the Services, you affirm that you meet these age requirements. We reserve the right to request proof of age or consent and to suspend accounts that violate this requirement.
To access certain features, you may need to create an account. Your account information should be accurate and updated regularly. You are responsible for maintaining the confidentiality of your password and for any activity under your account. Notify us at support@pokeman.app if you suspect unauthorized access to your account. You agree not to use another user's account or disclose your password to any third party.
We may allow registration and login through third-party platforms (e.g., Apple, Google). By using these features, you also agree to comply with the third-party platform's terms of service.
The Services are licensed, not sold, to you. Subject to your compliance with these Terms, Licensor grants you a limited, non-exclusive, non-transferable license to use the Services on any Apple-branded products that you own or control, as permitted by Apple's Usage Rules and these Terms.
If you sell or transfer your Apple device to a third party, you must remove the Services from the device beforehand.
You agree not to misuse the App by violating laws, infringing intellectual property or privacy rights, attempting to copy, modify, decompile, reverse engineer, or extract source code, using bots or other automated means to collect data, uploading harmful, offensive, defamatory, or illegal content, or selling, renting, or transferring access without our written consent.
All trademarks, logos, card images, names, and related intellectual property remain the property of their respective owners, Pokeman claims no ownership or partnership with official Pokémon products or brands.
You retain ownership of the content you upload while granting us a non-exclusive worldwide royalty-free license to host, display, and use it solely to operate and improve the Service.
You may not use Pokeman's name, logo, or design assets without prior written permission.
The App may access your camera to scan and identify trading cards, recognition accuracy depends on conditions such as lighting or card quality, results are provided on a best-effort basis without guarantees of completeness, and we reserve the right to modify, suspend, or remove the scanning functionality at any time without prior notice.
Pokeman uses AI models to provide educational assistance. While efforts are made to ensure accuracy, AI-generated content may contain errors. The information provided should be used as an aid and not as a definitive source. Use of such content is at your own risk, and Pokeman is not liable for any inaccuracies or decisions made based on the information provided.
Certain features of the App may require payment, which is handled exclusively through the platform where you downloaded the App (e.g., Apple App Store). Pokeman does not store or process payment information directly.
By purchasing a Premium Service or subscription, you agree to the displayed pricing and payment terms. Subscriptions automatically renew unless canceled before the end of the current term, and refunds are subject to the policies of the respective platform.
If you are a resident of the European Economic Area (EEA) or the United Kingdom, you have the right to withdraw from your subscription within 14 days of purchase. To exercise this right, please contact us at support@pokeman.app.
Fraudulent, abusive, or unauthorized payment behavior may result in suspension or termination of your access to paid features.
Your data is processed under our Privacy Policy, using the App implies consent to collect items such as images, usage statistics, or metadata to improve our services, and we do not sell or share personal data with third parties for commercial purposes without consent unless required by law.
The App may include or rely on data, links, features, or integrations provided by third parties, such as price databases, marketplaces, or authentication platforms (e.g., Apple or Google). Pokeman is not responsible for the accuracy, legality, performance, or availability of any third-party content or services.
Accessing or using these third-party services is at your own risk and subject to their respective terms and privacy policies. Pokeman does not endorse or assume any responsibility for third-party content or functionalities accessible through the App.
Pokeman monitors content to prevent harmful or illegal material. Automated systems and human moderators may review content. We reserve the right to remove content that violates these Terms or applicable laws. Users may report inappropriate content via support@pokeman.app.
The App and its content are provided "as is" without warranties, Pokeman does not guarantee uninterrupted service or accurate results, and the fullest extent of permitted law excludes liability or limits it to the amount paid for the App or related services.
We may suspend or terminate access if you breach these Terms or for operational or legal reasons, you may stop using the App and request deletion of your account and data, and clauses on intellectual property or liability limitations survive termination.
We may modify these Terms at any time with updates published in the App or on our website, and continued use after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris unless local laws provide otherwise for users in the EEA.
If any provision is found invalid or unenforceable the remainder stays in effect, failure to enforce a provision does not waive it, and these Terms constitute the entire agreement between you and Pokeman regarding App use.
